OGC Associates P.A. ("we," "us," or "our"), doing business as OGC Tax Pros, operates the OGC 365 platform (the "Service"), accessible at ogc365.com. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.

1. Information We Collect

1.1 Information You Provide Directly

• Account Information: Full name, email address, phone number, and company/business details.
• Financial Information: Bank account data connected through Plaid, including transaction history, account balances, and investment account data.
• Documents: Tax documents, financial statements, receipts, and other files you or your accountant upload to the Service.
• Communications: Messages exchanged between you and your accountant through the Service's messaging system.
• Payment Information: Invoice details and payment history. Credit card payments are processed through Stripe. ACH/eCheck payments are processed through Authorize.net. We do not store your full card or bank account numbers on our servers.

1.2 Information Collected Automatically

• Device and Usage Data: IP address, browser type, device type, access times, and pages viewed.
• Authentication Data: Login credentials and session information.

1.3 Information from Third Parties

• Plaid: Bank and investment account data synced through Plaid's API.
• Google: Basic profile information if you choose to log in with Google.
• Meta/WhatsApp: Phone number and message content for WhatsApp communications with your accountant.

2. How We Use Your Information

• To provide and maintain the Service, including bookkeeping, accounting, tax preparation, and financial reporting.
• To process payments for services rendered.
• To communicate with you about your account, invoices, documents, and tax matters.
• To send notifications about new messages, documents, or required actions.
• To comply with legal, accounting, and tax obligations.
• To improve and optimize the Service.

3. Third-Party Services

We share your information with the following third-party service providers:

4. Data Retention

We retain your information for two (2) years following the termination of your relationship with OGC Associates P.A. or the closure of your OGC 365 account, whichever occurs later. After this period, your personal data will be deleted or anonymized, except where longer retention is required by applicable federal or state tax laws, including IRS recordkeeping requirements.

5. Data Sharing and Disclosure

We do not sell, rent, or trade your personal information. We may disclose your information:

• To your accountant and authorized staff at OGC Associates P.A. who need access to provide services to you.
• To third-party service providers as described above.
• When required by law, court order, or government regulation.
• In connection with a merger, acquisition, or sale of assets, subject to confidentiality obligations.

6. Data Security

We implement appropriate technical and organizational measures to protect your information, including:

8. Account Deletion

You can delete your OGC 365 account at any time within the app's Account Settings. Upon deletion, your personal data will be scheduled for removal within 30 days, subject to legal retention requirements described in Section 4.

9. Users Under 18

The Service is a professional business tool designed for accounting and tax management. It is not directed at children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13, we will delete it promptly.

For users between 13 and 18 years of age (such as young business owners), we may process their information as authorized by their parent or legal guardian. If you are a parent or guardian and believe your child has provided information without your consent, please contact us at odijas@ogctaxpros.com.

10. International Users

The Service is hosted in the United States. If you access the Service from outside the U.S., your information will be transferred to and processed in the U.S. By using the Service, you consent to this transfer.

11. Cookies and Tracking Technologies

The Service uses essential cookies and similar technologies for authentication and functionality. We do not use advertising cookies or third-party tracking pixels.
